In a letter to DOJ Inspector General Michael Horowitz, which he shared on X, Bailey suggested that "unelected staff" members of the former president's administration may have taken advantage of Biden’s mental state to advance what he described as "radical" policies without the president’s full awareness.
“I am demanding the DOJ investigate whether President Biden’s cognitive decline allowed unelected staff to push through radical policy without his knowing approval,” Bailey stated in a post that accompanied the letter. “If true, these executive orders, pardons, and all other actions are unconstitutional and legally void,” he added.
Bailey pointed to what he referred to as "the streak of extraordinary far-left orders purportedly issued by Biden" during his last months in office. His list included Biden granting a retroactive blanket pardon to his son, Hunter, despite previously pledging not to do so, as well as making a "legally frivolous" assertion that the Equal Rights Amendment was part of the US Constitution.
“There are profound reasons to suspect” that Biden was manipulated by his staff, Bailey argued, citing former and current US officials, along with a prominent Democratic fundraiser who had previously mentioned the former president’s cognitive challenges.
Bailey also noted that House Speaker Mike Johnson implied that Biden was unable to comprehend the orders he was signing, confusing a moratorium on energy exports to Europe with a decree that authorized a study of those exports.
Lindy Li, a major Democratic National Committee fundraiser, remarked last month that “the people who ran our country for the last four years” were actually Biden’s staff, along with his wife and son Hunter.
The DOJ has yet to respond to Bailey’s request.
Concerns regarding Biden’s physical and mental capacity surfaced during his 2024 presidential campaign. Ultimately, he was pressured to withdraw from the race a hundred days before the election following a poor performance at a CNN-hosted debate with Trump last June.
