US judge declines to halt Musk's election giveaway

A Pennsylvania judge has permitted Musk's daily giveaway to proceed until the election on November 5, dismissing a request from the district attorney to halt it, labeling it as an “illegal lottery.”
On October 19, the CEO of X, SpaceX, and Tesla made the announcement that he would provide $1 million each day to a registered voter in a swing state who signs a petition advocating for "free speech and the right to bear arms." During a rally in Harrisburg, Pennsylvania, held the same day, he presented the first check and confirmed that the giveaway would continue until the election.
Philadelphia District Attorney Larry Krasner, a Democrat, initiated a civil lawsuit claiming that Musk is running an “illegal lottery.”
The lawsuit states that Elon Musk's political action committee America PAC, along with Musk himself, “are lulling Philadelphia citizens – and others in the Commonwealth – to give up their personal identifying information and make a political pledge in exchange for the chance to win $1 million.”
America PAC attorney Chris Gober contended that even though Musk characterizes the giveaway as random, it does not meet the criteria for a lottery.
“There is no prize to be won; instead, recipients must fulfil contractual obligations to serve as spokespersons for the PAC,” Gober remarked during a hearing before Common Pleas Court Judge Angelo Foglietta on Monday.
In response, Krasner’s office described Gober’s statement as a “complete admission of liability,” with attorney John Summers asserting during the hearing that Musk and the PAC have misled numerous Philadelphians by being deliberately vague about the details of the giveaways.
Musk, who had previously claimed political neutrality, publicly endorsed the Republican nominee following a failed assassination attempt on Trump on July 13. Last month, the billionaire disclosed that he had contributed $75 million to America PAC, which he established in July, with the goal of enhancing voter turnout for Trump in crucial swing states.
As the election approaches, polling indicates a tight race between Republican Donald Trump and Democrat Kamala Harris in key battleground states, with neither candidate holding a lead greater than two points.
