Trump administration agrees to limit DOGE access to the Treasury
The agreement was reached in response to a lawsuit alleging that the agency acted unlawfully by sharing private information with Elon Musk’s Department of Government Efficiency (DOGE).

Lawyers from the US Justice Department have consented to a proposed order that would temporarily prevent Elon Musk’s DOGE from accessing sensitive financial information from the Treasury Department.

This action by the Trump administration late on Wednesday comes after a lawsuit filed by a group of union members and retirees, who claimed that the Treasury engaged in “unlawful action” by disclosing payment information and private data to DOGE.

“The Defendants will not provide access to any payment record or payment system of records maintained by or within the Bureau of the Fiscal Service,” stated the proposed order.

An exception will be made for two special government employees at the Treasury connected to Musk — Tom Krause and Marko Elez. The document specifies that they will be allowed access “as needed” to carry out their duties, “provided that such access to payment records will be ‘read only’.”

Krause, a former CEO of Cloud Software Group, and Elez, a 25-year-old engineer who has worked at Musk’s X and SpaceX, are the individuals in question. Once endorsed by US District Judge Colleen Kollar-Kotelly, who is monitoring the case, the limitations on DOGE’s access to Treasury data will remain effective until a legal hearing set for February 24.

During a hearing earlier on Wednesday, Justice Department attorney Bradley Humphreys affirmed that the allegations regarding the Treasury disclosing personal information of US citizens were “incorrect.” He assured that there are no intentions for the special government employees at the agency to share any data with Musk or any external party.

DOGE, established by Trump and led by Musk, who also holds the title of a special government employee, seeks to identify and cut wasteful spending within the US government. Musk aims to decrease the federal deficit by at least $1 trillion, necessitating daily cuts averaging $4 billion. In a post on X on Monday, Musk referred to DOGE as “the wood chipper for bureaucracy.”
