The allegations against Trump included attempts to unlawfully overturn the 2020 election results, which he lost to Joe Biden, and mishandling classified documents post-presidency in 2021. Trump has maintained that the prosecution is politically motivated and claims that the case was orchestrated by Democrats.
“The court will grant the government’s motion to dismiss, and dismiss the superseding indictment without prejudice,” Columbia District Judge Chutkan stated in her decision, referencing the legal immunity granted to sitting US presidents.
Shortly after Smith filed motions to drop the charges against Trump, the court document was released.
Trump's spokesman, Steven Cheung, expressed approval of the ruling. “Today’s decision by the Department of Justice ends the unconstitutional federal cases against President Trump, and is a major victory for the rule of law,” Cheung noted in a statement. “The American people and President Trump want an immediate end to the political weaponization of our justice system and we look forward to uniting our country,” he added.
On Truth Social, Trump remarked that the charges against him are “empty and lawless, and should never have been brought.” He has indicated previous intentions to remove Smith from his position immediately if he begins a second presidential term, referring to the special counsel as a “crooked person.”
However, Trump still faces criminal charges in Georgia for an alleged scheme to overturn the 2020 election results. Additionally, in May, a New York jury found Trump guilty of campaign finance violations, although sentencing has been postponed indefinitely. Trump continues to deny any wrongdoing in all cases against him.
