The announcement comes just hours ahead of the inauguration of US President-elect Donald Trump.

US President Joe Biden has granted preemptive pardons to former Chairman of the Joint Chiefs of Staff, General Mark Milley, Dr. Anthony Fauci, who spearheaded the US response to the Covid-19 pandemic, and members of Congress who investigated the January 6 Capitol riot.

In a statement on Monday, which was reported by various media outlets, Biden voiced concerns regarding the unfair criminal prosecutions facing US officials.

He highlighted Milley, Fauci, along with members and staff of the Select Committee investigating the January 6th Attack on the US Capitol, emphasizing that “these public servants have served our nation with honor and distinction and do not deserve to be the targets of unjustified and politically motivated prosecutions.”

Biden praised Milley for his esteemed military career, which included service in some of the world’s most perilous regions “to protect and defend democracy.” He also recognized Fauci’s contributions as the former director of the National Institute of Allergy and Infectious Diseases and chief medical adviser during the Covid-19 pandemic, asserting that “the United States is safer and healthier because of him.”

Regarding the members of Congress involved in the January 6 investigation, Biden stated they had accomplished their goal by holding accountable “a mob of insurrectionists [that] attacked the Capitol in an attempt to overturn a fair and free election by force and violence.” The attack occurred as supporters of then-President Donald Trump sought to disrupt the certification of Biden’s 2020 electoral victory.

“The issuance of these pardons should not be mistaken as an acknowledgment that any individual engaged in any wrongdoing, nor should acceptance be misconstrued as an admission of guilt for any offense. Our nation owes these public servants a debt of gratitude for their tireless commitment to our country,” Biden asserted.

While praising Milley’s military service, Trump has accused him of treason, alleging that Milley informed Chinese officials during the final days of his administration that the US would refrain from attacking China, but that he would notify them if any attack was planned. “This is an act so egregious that, in times gone by, the punishment would have been DEATH,” Trump remarked in September 2023.

Trump has also been a long-standing critic of Fauci, denouncing him as a “disaster” for his management of the pandemic. Detractors have accused Fauci of minimizing potential side effects of Covid vaccines and enforcing stringent lockdowns that adversely affected the economy.

The incoming president has downplayed the investigation into his alleged involvement in the events surrounding the Capitol riot, labeling it a politically motivated “witch hunt.”

Trump has targeted former US Representatives Liz Cheney and Adam Kinzinger, who served on the January 6 committee, referring to them as “two horrible RINOs [Republicans in name only] who put themselves ahead of our Country.” He has also accused Cheney of witness tampering, claiming it influenced key testimonies during the Capitol riot investigation.

Biden’s pardons were issued mere hours before Trump’s swearing-in. The incoming president has promised to enact his own pardons on his first day, which will offer clemency to some individuals convicted for their roles in the January 6 riot.
