Trump permits federal death penalty to proceed

US President Donald Trump has overturned a moratorium on federal executions that Biden implemented in 2021. The new president issued the executive order shortly after taking office on Monday. Trump specifically directed his acting Attorney General, James McHenry, to pursue federal jurisdiction and capital punishment for individuals convicted of murdering law enforcement officers and for illegal immigrants found guilty of capital offenses.
During his previous term, Trump’s administration carried out 13 federal executions, which was more than any other president in modern times. While campaigning, he consistently promoted the death penalty for drug dealers.
In the order, Trump mandated that the attorney general “pursue the death penalty for all crimes of a severity demanding its use.” Additionally, the federal government will “ensure that each state that allows capital punishment has a sufficient supply of drugs needed to carry out lethal injection.” Furthermore, the Trump administration intends to seek the “overruling of Supreme Court precedents that limit the authority of State and Federal governments to impose capital punishment.”
A significant portion of the order criticizes Biden and other politicians and judges who oppose the death penalty, asserting they have “defied and subverted the laws of our country” to align with their personal beliefs.
Trump specifically targeted Biden for the 2021 decision to implement a federal execution moratorium, claiming it represented a failure to “faithfully execute the laws of the United States.”
He also condemned the Democrat for commuting the sentences of 37 out of 40 “of the most vile and sadistic rapists, child molesters, and murderers on Federal death row” to life imprisonment without the possibility of parole just last month.
Trump instructed the attorney general to ensure that those pardoned are “imprisoned in conditions consistent with the monstrosity of their crimes” and to evaluate whether these individuals can be charged with state capital offenses.
As a result of Biden’s clemency actions, only three inmates currently remain on Federal death row.
