According to Italian media, Italy is seeking to suspend the arrest warrant for Israeli Prime Minister Benjamin Netanyahu, which was issued last week by the International Criminal Court. As a signatory to the Rome Statute, Italy is legally obligated to comply with ICC decisions.
The proposal was allegedly presented by Italian Foreign Minister Antonio Tajani during a G7 Foreign Ministers’ meeting in Italy on Monday. Tajani called for a unified G7 stance on the arrest warrant and proposed that the criminal proceedings could be put on hold until the conclusion of the Israeli-Palestinian conflict, as reported by Il Messaggero.
The ICC, based in The Hague, announced on Thursday that it had issued arrest warrants for Netanyahu, his former Defence Minister Yoav Gallant, and Hamas leader Ibrahim al-Masri, relating to alleged war crimes and crimes against humanity associated with the Gaza conflict. The court has jurisdiction over the West Bank and Gaza, which are regarded as occupied Palestinian territories under international law.
If either of the Israeli politicians travels to any of the 124 countries that have signed the Rome Statute, including Italy, they could face arrest.
During the G7 meeting, Tajani remarked that while the court makes “legal decisions,” the responsibility for “political choices” lies with Western governments.
“We need to be united on this,” Tajani reportedly stated.
Euractiv reported that Tajani reaffirmed Italy’s recognition of the ICC, but when asked about the potential arrest of Netanyahu should he visit Italy, he pointed out that there is a form of immunity for high-ranking state officials.
Countries including Italy, the Netherlands, Switzerland, Ireland, Sweden, Belgium, the UK, and Norway have declared their intention to comply with the ICC warrant, while the US and Israel have expressed condemnation of the decision.
Israel initiated its military operation in Gaza following a cross-border incursion by Hamas on October 7, 2023, which resulted in approximately 1,200 deaths and 251 individuals taken hostage. Recent figures from Gaza’s health ministry indicate that over 44,000 Palestinians have died and more than 104,000 have been injured due to Israeli attacks on the region.
