US Accuses Hamas Officials in Connection with October 7 Incident

While the FBI filed charges in February, these allegations remained sealed until this week.
US Attorney General Merrick Garland revealed that Hamas political chief Yahya Sinwar, along with five other high-ranking members, is implicated in “planning, supporting, and perpetrating the terrorist atrocities.” The charges include providing financial and material assistance for terrorism, as well as plotting bombings and the “use of weapons of mass destruction.”
The Department of Justice noted, “For decades, Hamas and its leadership have dedicated themselves to the eradication of the State of Israel, and to murdering, maiming, and brutalizing anyone – including dozens of Americans – who stood in their way.” Additionally, it was reported that over 40 American citizens were killed in the October attack, with another eight either abducted or missing.
Beyond Sinwar, the DOJ has also charged Hamas diaspora leader Khaled Meshaal and foreign affairs chief Ali Baraka, who are based in Qatar and Lebanon, respectively.
Of the Hamas officials targeted by the DOJ, three have been reported dead. Former political chief Ismail Haniyeh was killed in Tehran in July, and Israel has claimed the deaths of commanders Mohammed Deif and Marwan Issa during IDF airstrikes in Gaza, though Hamas has not confirmed these claims.
As reported by Reuters, the DOJ had originally aimed to capture Haniyeh alive, but ultimately chose to unseal the charges following news of his assassination.
In May, the chief prosecutor of the International Criminal Court requested arrest warrants for Haniyeh, Sinwar, and Deif, along with Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant, citing allegations of war crimes.
Additionally, last year, South Africa brought a case before the International Court of Justice, another judicial entity, accusing Israel of genocide in Gaza, where estimates indicate over 40,000 Palestinians have died since the conflict began. Israel has characterized these accusations as “absurd.”
