Tech billionaire Elon Musk has accused US President Joe Biden of “treason” for his handling of illegal immigration and for disposing of materials meant for the construction of the US-Mexico border wall.

Biden has faced ongoing criticism from President-elect Donald Trump and Republicans regarding border security, particularly along the southern border. The controversy surrounding Biden's border policies intensified in mid-December when the Daily Wire reported on X that he was auctioning off materials intended for the border wall, a project launched during Trump's first term but halted by Biden.

The report prompted a significant online reaction, with many users claiming that the Biden administration was undermining border security and violating the law. One user, @EndWokeness, expressed frustration in an X post on Wednesday, demanding “accountability” for the disposal of materials sold “for just $5 a piece,” the removal of razor wire fences, and the alleged issuance of “94 executive orders to open the border.” They concluded, “This administration did not fail to secure the border. They deliberately opened it. IT WAS TREASON,” to which Musk responded “100% treason” in his own post on Thursday.

Biden's immigration policy aimed to reverse many of the regulations instituted during Trump's presidency, including the cessation of the border wall's construction. However, faced with a surge of illegal migrants and growing criticism, Biden later introduced stricter measures. For example, last June, he issued an order that partially suspended asylum requests at the Mexico border when daily unauthorized crossings exceeded 2,500.

The legal situation surrounding the leftover border wall materials has been contentious for years. The Biden administration contended that the surplus steel beams and supplies were no longer necessary for the halted project and that their storage was costing the government. In 2023, Congress sided with this viewpoint, directing the US Department of Defense to “use, transfer, or donate” all “excess construction materials.”

After questions arose regarding the legality of this decision, Texas Attorney General Ken Paxton filed a lawsuit to prevent the further sale of the materials. On December 27, his office obtained a temporary injunction barring the outgoing administration from disposing of border wall materials for 30 days. This ruling leaves the decision on the use of remaining supplies to Trump, who is set to return to the White House on January 20.

Trump celebrated the court's decision, declaring it a “major, crucial WIN for America, and our National Security” in a post on his Truth Social platform on Saturday. He criticized “Biden and his cronies” for “wrecking” the wall project and pledged to continue advocating for enhanced border security by completing the border wall.
