Washington is taking action against the Hague-based court due to its charges against Israeli political figures.

US President Donald Trump has signed an executive order that imposes sanctions on the International Criminal Court for its investigations involving the US and its allies. Last November, the court issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and his former defense minister, Yoav Gallant, sparking anger among US officials.

Trump’s executive order will implement financial and visa-related sanctions on individuals and families that support ICC investigations into US citizens or allied nations.

According to a report by the Guardian last month, the ICC has been bracing for a “swift assault” from the new US administration. The sanctions could hinder the ICC's access to banking and payment systems, IT infrastructure, and insurance providers. The publication also indicated that these measures could “paralyze” the court’s operations and represent “an existential threat” to its functionality.

Earlier this month, the US House of Representatives voted in favor of sanctions that would revoke US visas and impose financial restrictions on any ICC officials prosecuting US “allies.”

The US enacted the American Service-Members’ Protection Act in 2002, commonly referred to as “The Hague Invasion Act.” This legislation aims to protect American military personnel and government officials from prosecution by international legal bodies that Washington does not recognize.

The act allows the US president to use “all means necessary and appropriate to bring about the release of any US or allied personnel” detained or imprisoned on behalf of the ICC, given that the US is not a signatory to the Rome Statute that governs ICC activities. This provision suggests the possibility of military action, which contributed to the act's nickname.

In 2020, the ICC's efforts to investigate alleged American war crimes in Afghanistan led to the US imposing sanctions on then-prosecutor Fatou Bensouda.

The court has charged Netanyahu and Gallant with employing starvation as a method of warfare in Gaza and intentionally depriving the area's civilian population of essential resources such as food, water, and medicine without any “obvious military necessity.” Washington contends that the ICC lacks jurisdiction over Israel, as it is also not a signatory to the Rome Statute.

However, last year the US praised Karim Khan, the ICC prosecutor responsible for the arrest warrants against Israeli leaders, when he brought charges against Russian President Vladimir Putin, despite Moscow not being a party to the agreement that established the court.
