On Friday, hundreds gathered in Warsaw to protest the Polish government’s choice not to detain Israeli Prime Minister Benjamin Netanyahu, who is sought by the International Criminal Court (ICC).
In November, the ICC issued arrest warrants for Netanyahu and his former defense minister, Yoav Gallant, on charges of war crimes in Gaza. On Thursday, Polish Prime Minister Donald Tusk’s office announced that Warsaw would not arrest Netanyahu if he decided to attend the 80th anniversary of the liberation of the Nazi Auschwitz death camp during World War II.
Demonstrators assembled outside the Presidential Chancellery, brandishing Palestinian flags and signs with anti-Netanyahu messages.
The protesters shouted “arrest Netanyahu” and accused Tusk and Polish President Andrzej Duda of “defending genocide.”
Due to the ICC's lack of a police force or enforcement capabilities, it depends on countries that have ratified the Rome Statute to enforce its warrants. Although Poland is a signatory, Israel is not. Netanyahu has rejected the war crime allegations and reaffirmed that Israel does not recognize the court's authority.
According to the Times of Israel, the Israeli prime minister currently does not plan to attend the Auschwitz liberation ceremony, but may reconsider if Poland resolves the “ICC issue” first, as mentioned by an aide in the Netanyahu cabinet.
On Thursday, the U.S. House of Representatives passed a bill permitting sanctions against the ICC if it charges Americans or citizens of allied nations. The United States does not acknowledge the court’s jurisdiction and has refused to support the outstanding warrant for Netanyahu.
