Media reports: Germany requested Israel to agree to a 'genocide clause'

Germany has decided against supplying arms to Israel unless West Jerusalem provides a written guarantee that the weapons will not be utilized to target civilians in Gaza, according to reports from media outlets affiliated with Germany’s Axel Springer publishing house.
Berlin has not approved any arms sales to Israel since March, and it has stalled these sales while maintaining that the Jewish state is not under an arms embargo, as noted by PMG magazine on Monday. This information aligns with a report from the German tabloid Bild published over the weekend.
Bild reports that it was Baerbock and Habeck who “blocked new deliveries,” with the Green party leaders seeking assurances from Israel that the weapons would not be used against civilians in Gaza. The publication cited sources in government and defense circles, stating, “The Israeli government must give the German government a written assurance that arms exports from Germany will not be used for genocide.” Reports indicate that West Jerusalem provided the necessary assurances on Thursday.
German law prohibits the delivery of weapons to nations where there is a risk they may be used against civilians. An individual familiar with the matter explained to PMG, “Arms deliveries to Israel are about compliance with the rules of international humanitarian law. The reason for requesting such a commitment is that a German administrative court could otherwise put a stop to it.”
The developments have drawn criticism from opposition members and the ruling Free Democratic Party, with several politicians urging the Greens and Chancellor Olaf Scholz to “clarify” the situation concerning weapons exports. Friedrich Merz, leader of the Christian Democratic Union, stated to Bild, “Scholz, as the chairman of the Federal Security Council, also bears responsibility here.”
While Baerbock has publicly supported Israel’s right to defend itself, she emphasized in a speech last week that “international humanitarian law and Israel’s right to exist are inextricably linked.”
Israel has faced accusations of indiscriminately targeting civilians in Gaza, where over 42,000 Palestinians have died since the conflict between Hamas and Israel escalated in October 2023. The Israel Defense Forces have rejected the claims of committing genocide as “absurd,” asserting that Hamas has been using Palestinian civilians as human shields.
